Two lawsuits have been filed by Colorado residents asking for federal action to close the recreational marijuana market. This is the first in state legal action seeking to oppose the legalization of marijuana.
The two lawsuits were filed by owners of a horse farm and owners of a Holiday Inn with tacit support from anti-marijuana group Safe Streets. The aggrieved parties alleged that the marijuana industry is a clear violation of the Racketeer Influenced and Corrupt Organizations Act. The plaintiff further said that the proximity of recreational marijuana businesses is damaging their property due to the “offensive smell” and also driving away the legitimate businesses customers.
In response to the lawsuit, the Marijuana Policy Project posted on Facebook urged supporters to boycott the hotel brand.
The legal use as well as the sale of marijuana for medical and recreational purpose has become a hotly debated political issue in the US with numerous states contemplating legalizing initiatives.
In December Oklahoma and Nebraska had initiated a lawsuit against Colorado over the new marijuana market. Voters of Alaska, Oregon and Washington DC voted to legalize recreational marijuana. The Pennsylvania State Senate in September gave its consent to a legislation which would legalize recreational marijuana. A new legislation was signed by the Illinois Governor Pat Quinn in July to allow children and adult suffering from seizures access to medical marijuana. The Maryland House of Representatives in July passed a bill which would decriminalize the possession of small amounts of marijuana.
This has led to a serious debate- The legal marijuana experiment in two states, has it really worked? Polls suggest that majority of Americans support legal pot and in the coming year as many as 5 states will legalize recreational marijuana. It is a year since the first recreational pot shop has opened up in Colorado and most experts feel that there has not been any change which is discernable or as the adage goes “the sky is not falling”.
Most Coloradans will tell you that they could not make out any difference between the commercialized medical system which was already in place since 2009 and the new legalized recreational system. However there are a wide range of opinions about how America’s foray into marijuana legalization has worked out. As for now everyone will be awaiting the judgment in the two lawsuits which has been filed by the two Colorado citizens.
“The two lawsuits were filed by owners of a HORSE FARM and owners of a Holiday Inn…proximity of recreational marijuana businesses is damaging their property due to the “OFFENSIVE SMELL”.
definition of irony: a horse farm is complaining about the “offensive smell”.

Pot smoke carries THC to the lungs…and carpets as well. Bby crawls on carpet absorbing THC. Gets sick. Legal liability? Abuse? Endangerment? Tobacco leave a smell. Pot leaves a more lasting health threat footprint? Maybe not…but maybe yes? Just posing the querstion.
That is the dumbest argument I have ever heard, not only that, your grammar is so horrendous I cannot take you seriously. Post some links to support what you are trying to claim, because you come off as rather ignorant, opinionated and reactionary. “Just posing the question” is a cop out statement.
Does pot smoke carry THC into carpets?
Being that there are obviously far more dangerous things to be found inhabiting carpets, such as bacteria and viruses, than the trace amount of thc that could accumulate, your position is either not thought out very well or you are purposefully playing devil’s advocate, and not doing a good job at it.
THC is naturally occurring in the body. It’s a neurotransmitter. You have more in your system now than you could get from carpet contact. This is why the testing threshold is rather high, to exclude false positives. Thus the range of error to test your theory is larger than the amounts you are trying to detect.
And how about a small baby rubbing on it while crawling on the carpet? Get high?
“Pot leaves a more lasting health threat footprint?”
Not likely. The CDC reports 430,000 deaths per year from tobacco and zero from marijuana.
If they can afford the habit let them. Test any persons on govt. Assistance ( tax payer subsidy) if the have money for weed and drugs they don’t need govt. Subsidies. Medi-cal conditions excluded.
If you’re not interested in being reasonable you might as well just keep your hogwash to yourself. We are not going to accept 2nd class citizen status.
The several states that did tests were getting less than one in 400 positives. Given the fact that 400 times $20 tests is $8000, it was found that testing increased costs, rather than generating benefits due to saving on assistance payments. It resonates great with the Rethuglican base, but costs ten times what it saves.
